Hereinafter, the “Web Site”: https://www.medically-no-nonsense.com is referred to as “MNN”.
1.3. This page states the Terms and Conditions under which you may use MNN . Use of the words “MNN” or “Our” or “Us” herein, reflects the legal producers and owners of MNN. The owner of MNN is Dr. J, LLC.
1.4. If you do not accept these Privacy Policies, and Terms and Conditions wholly or in part, your only recourse is to terminate this Agreement and not use the MNN Web Site. By using this Web Site, you are indicating your acceptance to be bound by these Terms and Conditions. MNN may revise these Terms and Conditions at any time by posting an update to this page. You should visit this page periodically, because your continued use of the Web Site following the posting of changes to these Terms and Conditions will mean you accept those changes. The terms “you” and “user” as used herein refer to all individuals and/or entities accessing the Web Site for any reason.
2. Key Definitions
2.1. “Clickstream Data” or “User Activity” means a record of any MNN or external party content viewed by you, your clicks on links to content on MNN Sites and any third party websites, and any information supplied by you in the process of submitting a registration form. It is the virtual trail that a User leaves behind when accessing the websites. A clickstream is a record of a User’s activity on the websites and every page the User visits, how long the User was on a page or site, in what order the pages were visited, any forums, that the User participates in or any comments made on the site.
2.2. “Clear GIFs“, also known as web bugs, beacons or tags, are small graphic images placed on a web page, web-based document, or in an e-mail message. Clear GIFs are invisible to the user because they are typically very small and the same color as the background of the web page, document or e-mail message. The Website may use clear GIFs to capture statistical usage information for web pages, features or other elements on a web page.
2.3. “Co-Branded Site” means a website hosted by a third party business partner of MNN, the content and branding of which is shared with that third party business partner under contractual obligations between MNN and our partner.
2.4. “Content” means all writing, audio, video on MNN, including white papers, analyst reports, webcast, videocast, newsletters, software demo or other document or media presentation that is linked to or displayed on MNN.
2.5. “Content Sponsor” means a third party that owns or sponsors Content on the Site(s).
2.6. The “DoubleClick DART ((Dynamic Advertising Reporting & Targeting) Cookie“.The DoubleClick DART cookie is used by Google in the ads served on the websites of its partners, such as websites displaying AdSense ads or participating in Google certified ad networks. When users visit a partner’s website and either view or click on an ad, a cookie may be dropped on that end user’s browser.
2.7. “Guest Visitor” means anyone above the age of 18, visiting MNN website.
2.9. “Google Analytics Cookies” are HTTP Cookies to “remember” what a user has done on previous pages / interactions with the website. More details are at: https://developers.google.com/analytics/devguides/collection/analyticsjs/cookie-usage.
2.10. “Member” means a User that (i) registers on MNN to become a member, (ii) subscribes to a newsletter on MNN or (iii) registers to requests demos, brochures or other product information on or from MNN.
2.11. “Member Information” means information which you provide which may include, but shall not be limited to: your name and address, telephone number, country, zip code, telephone number. Member information may also include your health information, as well as any Supplemental Information (as defined below).
2.12. “Service Provider” means a company that provides services to MNN with regard to the operation of its websites or the collection/review of data from the MNN websites.
2.13. “Sites” “MNN Site” or “Websites” means the network of websites owned and operated by MNN.
2.14. “Sponsored Content” means Content available through the Site(s) and owned or sponsored by a third party.
2.15. “Third Party Websites” means websites not owned and controlled by MNN.
2.16. “Tracking Technology” means Cookies, Clear GIFs, serving tracking technologies or other technology solutions tracking activities of a user on MNN wesbsite.
2.17. “User” or “you” means any person viewing any page of MNN website. A User need not be a Member.
2.18. “Web Beacon,” also called a Web bug or a pixel tag or a Clear GIF. Used in combination with cookies, a Web beacon is an often-transparent graphic image, usually no larger than 1 pixel x 1 pixel, that is placed on a Web site or in an e-mail that is used to monitor the behavior of the user visiting the Web site or sending the e-mail.
2.19. “Personally Identifiable Information” (“PII”): Information that can be linked to an identifiable individual person. This type of data includes things like full name, home address, telephone number, or email address.
2.20. Non-Personally Identifiable Information (“Non-PII”): Information that cannot identify an individual person, such as IP address, browser types, operating systems, domain names, access dates and times, referring website addresses, online transactions and browsing and search activity.
2.21. “IBA” means Interest Based Advertising.
3. Scope and Third Party Websites
3.4. When you want a purchase a product you may be linked to a third party website. You will be leaving the MNN network of Sites and will be redirected to the Seller’s site and you will be subject to the policies of that Seller’s website.
4. What Information do We Collect?
4.1. Member Information: A MNN goal in collecting Member Information is to provide you with the best and most useful content, products, and services, and to offer you opportunities to obtain other products and services from us and our partners. Because we derive revenue from advertising, collecting information is essential to keeping our services available to users. We collect Member Information when you provide it to us through the following: when you register on one of our Sites, subscribe to an e-mail newsletter, register for one of our events or register to request certain Content or through surveys, as well as when you register to become a Free or Paid Member. Several of the services that we offer on our Sites may require registration as a condition of use. Some of the content is exclusive to Paid Members. Once you register with one of the MNN Sites, you are no longer anonymous to us. To the extent that we combine any Clickstream data with the information provided by you, it will be considered to be part of your Member Information. We will collect your IP address, DNS information, name, address, telephone number, etc. Providing your health information to Dr. J under “Ask Dr. J Program” is voluntary. Any health information provided by you will be governed by HIPPA Policy. WE DO NOT SHARE YOUR PERSONAL INFORMATION WITH THIRD PARTIES. However, We may share your information with third party service providers with whom we have contracted, MNN and its subsidiaries and affiliates, third party marketing partners, business partners and our clients and publishers, and as expressly provided for herein.
4.3. Log Files. MNN makes use of log files. The information inside the log files includes internet protocol ( IP ) addresses, type of browser, Internet Service Provider ( ISP ), date/time stamp, referring/exit pages, and number of clicks to analyze trends, administer the site, track user’s movement around the site, and gather demographic information. IP addresses, and other such information are not linked to any information that is personally identifiable. When visiting MNN, the IP address used to access the site will be logged along with the dates and times of access. This information is purely used to analyze trends, administer the site, track users movement and gather broad demographic information for internal use. Most importantly, any recorded IP addresses are not linked to personally identifiable information.
4.4. Email Communications, Newsletter and Related Services. MNN provides you with the opportunity to receive communications from us. You can sign up for a free email newsletter. and other digital downloads, periodic notifications. You can unsubscribe from this newsletter or digital downloads or periodic notifications at any time by sending email to email@example.com. Email communications that you send to us via the email links on our site may be shared with a customer service representative, employee, medical expert or agent that is most able to address your inquiry. We make every effort to respond in a timely fashion once communications are received. Once we have responded to your communication, it is discarded or archived, depending on the nature of the inquiry.
4.7. DoubleClick DART Cookie
4.7.2. Google’s use of the DART cookie enables it to serve ads to users based on their visit to MNN and other sites on the Internet.
4.7.6. MNN has no access to or control over these cookies that are used by third-party advertisers.
4.7.7. You can opt-out of cookies from advertising cookies by visiting the opt-out section of: Google Adsense, Google Adwords, Commission Junction, Widget Bucks, Adbrite, Clickbank, Azoogle, Chitika, Linkshare, Amazon, Kontera.
4.7.9. If you wish to disable cookies, you may do so through your individual browser options. More detailed information about cookie management with specific web browsers can be found at the browsers’ respective website.
4.7.10. The Sites also enable third-party tracking mechanisms to collect your non-personal information for use in online behavioral advertising. For example, third parties may use the fact that you visited the Sites to target online ads for MNN to you on non-MNN websites. In addition, our third-party advertising networks might use information about your use of the Sites to help target specific technology-related or other non-MNN advertisements to you based on your online behavior. For information about behavioral advertising practices, including privacy and confidentiality, visit the Network Advertising Initiative website or the Digital Advertising Alliance website.
4.7.11. The use of online tracking mechanisms by third parties is subject to those third parties’ own privacy policies, and not this Policy. If you prefer to prevent third parties from setting and accessing cookies on your computer, you may set your browser to block cookies. Additionally, you may remove yourself from the targeted advertising of companies within the Network Advertising Initiative by opting out here, or of companies participating in the Digital Advertising Alliance program by opting out here. Although our Sites currently do not respond to “do not track” browser headers, you can limit tracking through these third-party programs and by taking the other steps discussed above.
4.8. Registration Information: When you register on MNN, the registration form requires Users to provide information such as your name, address, telephone, email address and/or additional information, including preferences of medical products and devices. MNN hosts contests for free gifts. To participate in these contests, you will have to register and provide personal information: your name, address, telephone, email address and/or additional information. If you choose not to provide certain Member Information when registering with MNN Web Site, certain products or services may not be available to you.
4.9. Personal Information: The Sites include an “email a friend” feature, which allows a User to email Content to a third party; we only use the email address of that person for purposes of emailing that Content to that person.
4.10. eBook, Newsletter, Brochure Registration Information: Some of the Sites offer downloads of eBooks, Newsletters, Brochures, etc. Once a User registers to receive such material(s), their registration information is shared with vendors and/or resellers of those material(s). This information is forwarded to the vendor and/or reseller so that the User can receive additional information on products or services from that vendor and/or reseller.
4.11. User Generated Content: Some Sites feature user generated content in the form of a user review section or forum communities. In order to interact in these forums, a User must first complete the applicable registration form and, in some case, Terms of Service for the Site. The information provided by the User may be displayed in the User’s public profile in our forums and can be viewed by all visitors to this Site. However, to ensure total privacy of our Users, we do not display any User e-mail addresses.
4.12. Supplementary Information: MNN may supplement Member Information with information about a Member that is publicly available or that is made available by third parties through paid subscriptions. For example, if a Member provides the name of the brand of cosmetic prefers, we may obtain information showing the number of users of that particular cosmetic brand from the same zip code.of the Member. This information is called “Supplementary Information” and, once added to Member Information, is deemed to be included in that definition.
4.13. User System Information: MNN’s webcast application provides a system test that determines whether you can view a webcast from your computer. This information is used to optimize the viewing experience and to troubleshoot webcast viewing problems. We do not collect or retain personally identifiable information in conducting these tests.
4.14. Membership Information: When you signup for Free or Paid Membership, we ask you to complete an order form that requests certain information from you, including a credit card number and expiration date and general contact details. We do not retain the credit card information.
4.15. Access Device and Browser Information. When you access MNN from a computer, mobile phone or other device, we may collect information from that device about your browser type, location, and IP address, as well as the pages you visit.
4.16. Cookie Information. We use “cookies” (small pieces of data we store for an extended period of time on your computer, mobile phone, or other device) to make MNN easier to use, to make our advertising better, and to protect both you and MNN. For example, we use them to store your login ID (but never your password) to make it easier for you to login whenever you come back to MNN. We also use them to confirm that you are logged into MNN, and to know when you are interacting with MNN Platform applications and websites, our widgets and Share buttons, and our advertisements. You can remove or block cookies using the settings in your browser, but in some cases that may impact your ability to use MNN.
4.17. Information from other websites. We may institute programs with advertising partners and other websites in which they share information with us: We may ask advertisers to tell us how our users responded to the ads we showed them (and for comparison purposes, how other users who didn’t see the ads acted on their site). This data sharing, commonly known as “conversion tracking,” helps us measure our advertising effectiveness and improve the quality of the advertisements you see.
We may receive information about whether or not you’ve seen or interacted with certain ads on other sites in order to measure the effectiveness of those ads.
4.18. Advertisements. Sometimes the advertisers who present ads on MNN use technological methods to measure the effectiveness of their ads and to personalize advertising content. You may opt-out of the placement of cookies by many of these advertisers here. You may also use your browser cookie settings to limit or prevent the placement of cookies by advertising networks.
4.19. Links. When you click on links on MNN you may leave our site. We are not responsible for the privacy practices of other sites, and we encourage you to read their privacy statements.
4.20. Social Media Cookies. Most of the Social Media networks (Facebook, Twitter, Google+, etc) place a cookie when you visit them. MNN has no control over Social Media Cookies. You can visit each Social Media network to disable cookies.
5.0. How We Use Your Information
We use the information we collect to try to provide a safe, efficient, and customized experience. Here are some of the details on how we do that:
5.1. To manage the service. We use the information we collect to provide our services and features to you, to measure and improve those services and features, and to provide you with customer support.
5.2. To contact you. We may contact you with service-related announcements from time to time. You may opt out of all communications except essential updates by entering Opt Out in the Contact Us page.
5.3. To serve personalized advertising to you. We don’t share your information with advertisers without your consent. (An example of consent would be if you asked us to provide your shipping address to an advertiser to receive a free sample.) We allow advertisers to choose the characteristics of users who will see their advertisements and we may use any of the non-personally identifiable attributes we have collected (including information you may have decided not to show to other users, such as your birth year or other sensitive personal information or preferences) to select the appropriate audience for those advertisements. For example, we might use your interest in weight loss to show you ads for weight loss, but we do not tell the weight loss supplements company who you are. You can see the criteria advertisers may select by visiting our advertising page. Even though we do not share your information with advertisers without your consent, when you click on or otherwise interact with an advertisement there is a possibility that the advertiser may place a cookie in your browser and note that it meets the criteria they selected.
5.4. To serve social ads. We occasionally pair advertisements we serve with relevant information we have about you and your friends to make advertisements more interesting and more tailored to you and your friends.
5.5. To supplement your profile. We may use information about you that we collect from other MNN users to supplement your profile (such as when you are tagged in a photo or mentioned in a status update). In such cases we generally allow you to direct how that information is shared in your privacy settings or give you the ability to remove the content (such as allowing you to remove a photo tag of you) or limit its visibility on MNN.
5.6. To make Suggestions. We use your profile information, the addresses you import through our contact importers, and other relevant information, to help you connect with your friends, including making suggestions to you and other users that you connect with on MNN. If you want to limit your visibility in suggestions we make to other people, you can adjust your search visibility privacy setting, as you will only be visible in our suggestions to the extent you choose to be visible in public search listings. You may also block specific individual users from being suggested to you and you from being suggested to them.
5.7. Downloadable Software. Certain downloadable software applications and applets that we offer, such as our mobile apps, weight loss calculators, browser toolbars, photo uploaders, etc., transmit data to us. We may not make a formal disclosure if we believe our collection of and use of the information is the obvious purpose of the application, such as the fact that we receive photos when you use our photo uploader. If we believe it is not obvious that we are collecting or using such information, we will make a disclosure to you the first time you provide the information to us so that you can decide whether you want to use that feature.
5.8. Memorializing Accounts. If we are notified that a user is deceased, we may memorialize the user’s account. In such cases we restrict profile access to confirmed friends, and allow friends and family to write on the user’s Wall in remembrance. We may close an account if we receive a formal request from the user’s next of kin or other proper legal request to do so.
6. Use and Disclosure of Information We Collect
6.1. Member Information: The Content Sponsors make the Sponsored Content available through MNN in return for receiving the Member Information of Users who request Sponsored Content, as well as, in certain cases, Clickstream Data from Users. Accordingly, if you request Sponsored Content, MNN may disclose your Member Information to a Content Sponsor, as set forth in more detail below. If you do not want this information disclosed to a Content Sponsor, do not request Sponsored Content. MNN’s customer agreements with Content Sponsors: (a) provide that the Content Sponsor may use this information to contact you via common methods of communication; and (b) prohibit disclosure of the information to any third party other than agents of the Content Sponsor for the permitted marketing purposes set forth above. You should contact the Content Sponsor directly if you have any questions about their use of this information. We use Member Information to deliver email newsletters on topics of interest to Members who have requested those services. We may also send general promotional and marketing materials to our Members, including marketing research surveys. MNN, in some cases utilizing a Service Provider, deploys surveys and incentives. We also use Member Information in aggregated form to understand our Member base, and to market our services to our customers. In addition, under certain conditions we will inform a customer of MNN that a pre-existing contact in their CRM system is also a Member.
6.2.1. Help us recognize your computer as a previous visitor, and save and remember any preferences that may have been set while you were visiting one of our Web Sites or a Co-Branded Site.
6.2.2. Track, accumulate and report information on our Sites and Content usage to our partners and customers so that they can measure the effectiveness of advertisements and content viewed on the Web Sites;
6.2.3. Help us customize the content and advertisements you are shown while visiting our Web Sites and potentially other web sites online;
6.2.4. Determine which features Users like best to help us improve our Content and Sites, personalize your user experience, and measure overall Site effectiveness; and
6.2.5. Disclose Activity Intelligence information as detailed below.

6.4. Disclosure of Activity Intelligence Information: Certain customers of MNN receive or are granted access to reports that may include your Member Information linked to Clickstream Data derived from your activity on the Sites.
6.5. Disclosure of Aggregated Information: We provide summary reports, based on our analysis of Clickstream Data, which may include a description of your level of activity on our Sites, as well as activity related to editorial and vendor content. An example of the type of information included in a summary report is “3000 people looked at the xyz white paper this week and, of those 3,000 people, 60% clicked through to read the full white paper.” This information is aggregated and does not disclose any Member Information. MNN may also disclose aggregated user statistics (for example, 25% of our users are interested in Networking) to our customers, prospective customers and partners and other third parties, and for other lawful purposes.
6.6. Use of User Information for Predictive Analytics: MNN may also analyze user activity statistics for predictive analytics that will be provided to our customers, prospective customers, partners and other third parties, (for example, Users in zip code 99999 are researching XYZ Anti-aging Solution). This type of disclosure does not disclose any Member Information.
6.8. Transaction Information: We use this information to complete the transaction that you have requested, i.e. to deliver information, products, membership suscription or other services that you order and to invoice you. We do not store your credit card information.
7. How we Share Your Information?
8. How Can You Opt Out of Use and Disclosure of Your Information?
8.1. MNN has implemented reasonable security measures to protect information from loss, misuse and unauthorized access, disclosure, alteration or destruction. Our security systems include authenticated access to internal databases, audits of procedures, and regular reviews of overall Web security.
9. Access and Updating of Information
9.1. The instructions to review, amend, or delete your information may be found in the edit profile area on any of our sites. Users may change information at any time and as often as necessary. Users who are experiencing problems with our services or who have questions about how our services work can contact us by sending an email to: firstname.lastname@example.org.
10.1. We retain Non-PII for IBA for no more than eighteen (18) months. Aggregate reports generated from such data may be retained for a longer period, as ad delivery and reporting data.
11. Registration Password
11.1. Your Member Information is password-protected to control access to this profile information by third parties. We recommend that you do not divulge your password to anyone. MNN never asks for passwords in unsolicited phone calls or unsolicited emails.
13. AGE RESTRICTION
13.1. This Web Site and other MNN branded Web Sites are intended for use by individuals of 18 years of age or older.
13.2. This website is not directed for use by children under the age of 18.
13.3. Users under the age of 18 should get the assistance of a parent or guardian to use this Web Site.
14.1. You agree to indemnify and hold harmless MNN, its parents, affiliates, licensees and their respective directors, officers, employees and agents from and against all liabilities, claims damages and expenses, including attorneys’ fees, arising out of your use of the MNN Web Site, or your violation or alleged violation of the terms of this Agreement.
15. CHOICE OF LAW
15.1. This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware without giving effect to any principles of conflicts of law. If any provision of this Agreement is deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
16. DISPUTES AND BINDING ARBITRATION
16.2. In the event of any dispute you must first contact MNN at: email@example.com and settle. The email should be sent with options: “Request a Delivery Receipt” and “Request a Read Receipt”. You must allow 60-days for mutual settlement.
16.3. BOTH PARTIES AGREE TO BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER.
16.4. All disputes between you and MNN will be resolved by binding arbitration. You thus give up your right to litigate disputes with us in court. Disputes will be decided by a neutral arbitrator and not a judge or jury.
16.5. To settle disputes, both parties agree to submit to American Arbitration Association (AAA) seated in Atlanta, Georgia or Atlanta International Arbitration Society (ATLAS), seated in Atlanta, Georgia.
17.1. We reserve the right to change the Terms and Conditions in this Agreement and documents contained in Legal Notices at any time without prior notice. Such modifications shall be effective immediately upon posting the modified terms and conditions on MNN.
17.2. You agree to review the Agreement periodically to be aware of such modifications, and your accessing or using the service constitutes your acceptance of the agreement as it appears at the time of your access or use.
17.3. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT AND NOT USE MNN WEB SITE.
